Terms of Service - Kibo

1. Who we are and what Kibo is

Kibo is a personal growth and emotional support app operated by E-SPOT DIVERT S.R.L., a Romanian company with its registered office at Str. Popa Șapcă nr. 24, Voluntari, Ilfov County, Romania, Trade Registry no. J2022001375231, VAT no. RO45723091 ("we"). Kibo uses artificial intelligence to build your personal psychological profile, suggest daily actions, and accompany you through evening reflections and conversations. By using the app you accept these terms.

2. Kibo is NOT a medical service

This is the most important section, so we say it plainly:

• Kibo is not psychotherapy, not medical advice, and does not replace a psychologist, psychiatrist or doctor.
• Kibo is a self-knowledge and healthy-habits tool built on principles from psychology, but operated by an AI, not by a licensed professional.
• AI responses can be incomplete or wrong. Do not make important health decisions based on them alone.
• If you are in crisis (thoughts of self-harm, suicide, danger), use the emergency resources shown in the app or call your local emergency services immediately (112 in the EU, 988 in the US). Kibo is not a crisis intervention service.

3. Who can use Kibo

You must be at least 16 years old (or between 13 and 16 with parental/guardian consent, where the law allows). By creating an account you confirm you meet the age requirement and that the information you provide is truthful.

4. Your account

You are responsible for keeping your credentials safe. We recommend enabling biometric lock (Face ID) in Settings. You can request account deletion at any time, directly in the app.

5. Subscriptions, trial and payments

• Kibo works on a subscription basis (monthly or yearly), with a free trial period clearly shown before you subscribe.
• Subscription payments are processed exclusively through the Apple App Store. Subscriptions renew automatically until you cancel from your Apple account settings (Settings - Subscriptions), at least 24 hours before the end of the current period.
• The reports on meetkibo.com (the Portrait and the Answer) are bought through a subscription, processed through Stripe; the payment is collected by E-SPOT DIVERT S.R.L. You pay the entry price once, shown before you pay, and get the report straight away. After 14 days the monthly subscription starts, at the price shown in the same place, and renews monthly until you stop it. You can stop it anytime yourself, from your report page (a button that opens the Stripe billing portal), or with an email to contact@meetkibo.com: after that nothing else is charged, and the report stays yours. You keep your statutory 14-day right of withdrawal, and our guarantee is simpler still: if the report doesn't feel like you, write us an email and you get your money back, no explanation needed.
• Prices are shown in the app before any payment. They may vary by country and may change for future billing periods, with prior notice.
• Gems are a consumable virtual currency used only inside the app (e.g. streak freezes). Gems have no monetary value and cannot be transferred or redeemed for money.
• Refunds follow Apple's policy; you can request one at reportaproblem.apple.com.

6. Acceptable use

Please do not: (a) use Kibo for illegal activities; (b) attempt to access other users' data or compromise the security of the service; (c) systematically extract generated content to build competing products; (d) impersonate another person. We reserve the right to suspend accounts that violate these terms.

7. Your content and ours

• Your content (reflections, messages, answers) remains yours. You grant us only the technical license needed to process it in order to provide the service (see the Privacy Policy).
• The app, the Kibo brand, the mascot, the design and system-generated content belong to us and are protected by copyright. You may use them only as part of normal use of the app.

8. Limitation of liability

To the maximum extent permitted by law: the service is provided "as is"; we do not guarantee it will be uninterrupted or error-free; we are not liable for decisions made based on AI suggestions; our total liability to you is limited to the amounts you paid for the service in the last 12 months. Nothing in these terms limits rights that consumer law grants you mandatorily.

9. Termination

You can stop using the service and delete your account at any time, in the app. We may suspend or close accounts that violate these terms, with notice where reasonable.

10. Changes

We may update these terms. For material changes we will notify you in the app before they take effect. If you disagree, you can stop using the service and delete your account.

11. Governing law

These terms are governed by Romanian law. Disputes are resolved by the competent courts in Romania, without affecting your mandatory consumer rights in your country of residence (EU). You may also use the EU online dispute resolution platform (ec.europa.eu/consumers/odr).
